Terms of Service

1. Agreement to Terms

These Terms are a binding agreement between you and Dryden Labs LLC ("Pullt," "we," "us"). They govern your use of the Pullt website, web/mobile-web app, browser extension, and related services (the "Service"). By creating an account, installing the extension, using the free plan, or using the Service, you agree to these Terms and our Privacy Policy. You must be at least 18.

2. Description of the Service

Pullt helps collectors track card collections and provides estimated market values. It includes: the Tracker (web/mobile app to record cards + upload photos), the Pullt Live browser extension (lets you box a region of your screen — e.g., a card on a live auction stream — capture it, identify the card via AI, and overlay estimated prices), and value estimates from third-party price data + AI ID. The extension is information only: it does not bid, buy, or automate any auction activity. You are solely responsible for your buying/selling/bidding decisions.

3. Accounts

Provide accurate info; safeguard your credentials; you're responsible for activity under your account. Notify support@pullt.ai of unauthorized use.

4. Subscriptions, Free Plan, Billing, Cancellation

• 4.1 Free Plan. A no-cost plan, free forever, capped at 20 tracked cards and 5 scans/day. No credit card and no trial period — there is no countdown and the free plan never auto-converts to paid. You upgrade to Pro only by your own action when you want unlimited use or the Pullt Live extension.
• 4.2 Pro & the 7-day trial. The Pullt Live extension and unlimited use are Pro-only. The way to try Pro is a 7-day trial that requires a credit card. By starting the trial you authorize us to charge your payment method, and the trial automatically converts to a paid subscription at the end of the trial unless you cancel before it ends. You will be billed the then-current monthly or annual price.
• 4.3 Subscriptions renew automatically (monthly/annual) at checkout prices until you cancel. Each renewal charge is authorized in advance and is non-refundable.
• 4.4 Payments via Stripe; we don't store full card numbers.
• 4.5 Price changes with reasonable advance notice, effective next cycle.
• 4.6 Cancellation. You can cancel anytime in settings. Cancellation only stops future renewals — it does not refund fees already paid, and your Pro access continues through the end of the period you already paid for. To avoid being charged when a trial converts, you must cancel before the trial ends.
• 4.7 NO REFUNDS — all sales are final. All payments to Pullt are final and non-refundable. This expressly includes (a) charges that result when the 7-day Pro trial auto-converts to a paid subscription, (b) any monthly or annual renewal, and (c) unused time or features in a billing period. We do not provide partial, pro-rated, or retroactive refunds, and forgetting to cancel is not grounds for a refund. The sole remedy for not wanting future charges is to cancel before the next renewal. Except where a non-waivable refund right is required by applicable law, no refunds are given for any reason.
• 4.8 Failed payments may lead to retry/suspension/termination.

5. Acceptable Use

No: unlawful use; reverse engineering/scraping the Service or its data beyond personal use; using the Service to violate any third party's terms (incl. Whatnot/eBay); reselling/redistributing the Service or its data outputs without permission; uploading illegal/infringing content; interfering with the Service; unauthorized access.

6. User Content

You own your collection data and photos. You grant us a non-exclusive license to host/process/display it solely to operate and improve the Service for you (incl. AI identification). You represent you have rights to upload it. Keep your own backups.

7. AI Output — A Guide, Not Advice

7.1 Pullt uses artificial intelligence. Pullt uses AI (including third-party AI vision models) to identify cards from your photos and screen captures and to estimate market values. By using the Service you acknowledge that these results are AI-generated. AI output can be wrong, incomplete, or out of date — it may misidentify the card, grade, parallel, edition, condition, or authenticity, and it may report an inaccurate or outdated value.

7.2 It's a guide, not advice. All values and signals Pullt shows — including raw / PSA 9 / PSA 10 estimates and any DEAL / FAIR / OVERPAY indicators — are an informational guide only. They are not financial, investment, appraisal, or purchasing advice, and Pullt is not an appraiser, broker, dealer, auctioneer, or financial advisor. Results may vary. We do our best to provide accurate market data but make no guarantee of accuracy, completeness, or timeliness. Do not rely on the Service as the sole basis for any buying, selling, bidding, insurance, or investment decision — always verify independently before you buy.

7.3 Not liable for your losses. Pullt is not responsible for any financial loss, overpayment, missed opportunity, or other outcome resulting from purchases, sales, bids, or grading decisions you make using the Service. You alone are responsible for your own decisions. To the maximum extent permitted by law, we disclaim all responsibility for any decision made, or action taken, in reliance on AI output, value estimates, or any other information from the Service.

8. No Affiliation; Third-Party Marks

Pullt is independent and not affiliated with, endorsed by, or connected to Whatnot, eBay, PriceCharting, any card manufacturer, or grading company. Third-party names/marks are property of their owners, used descriptively only. Your use of any third-party site is governed by that party's terms.

9. Intellectual Property

The Service (software, design, the Pullt name/branding) is owned by us/our licensors. We grant a limited, revocable, non-exclusive license for your personal, non-commercial use per these Terms.

10. Third-Party Services

We rely on hosting, Stripe, price-data providers, and an AI vision provider, provided "as is"; we don't warrant their accuracy/availability.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND (incl. merchantability, fitness, accuracy, non-infringement). We don't warrant it will be uninterrupted, error-free, or accurate.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WON'T BE LIABLE FOR INDIRECT/INCIDENTAL/SPECIAL/CONSEQUENTIAL/PUNITIVE DAMAGES OR LOST PROFITS/DATA. OUR TOTAL LIABILITY WON'T EXCEED THE GREATER OF WHAT YOU PAID US IN THE PRIOR 12 MONTHS OR $100.

13. Indemnification

You'll indemnify Pullt from claims arising out of your User Content, misuse, or violation of these Terms or any law/third-party right.

14. Termination

You may stop and delete your account anytime. We may suspend/terminate access for violations, fraud, non-payment, or risk. Disclaimers, liability limits, indemnification, and governing law survive.

15. Governing Law

Texas law governs (no conflicts rules); exclusive venue in Bexar County, Texas. [ATTORNEY DECISION: arbitration + class-waiver clause?]

16. Changes

We may modify these Terms; material changes get reasonable notice. Continued use = acceptance.

17. Misc

Entire agreement w/ Privacy Policy; severability; no waiver; you may not assign, we may (merger/sale).
